American Stone Center – Terms of Service

By accessing the American Stone Center website, placing an order, or purchasing any product, you agree to be legally bound by the following Terms of Service, as well as our Return Policy, Shipping Policy, and Privacy Policy. These terms are established to protect both the customer and American Stone Center and reflect standard practices in the natural stone industry.


1. Acceptance of Terms

By placing an order, you confirm that you have:

  • Read and understood all policies

  • Accepted all terms without exception

  • Verified product details, quantities, and suitability prior to purchase

American Stone Center reserves the right to refuse, cancel, or limit any order at its sole discretion.


2. Product Disclaimer – Natural Stone (CRITICAL)

All products sold by American Stone Center are 100% natural stone.

Natural stone is a material formed by nature and will inherently contain variations, including but not limited to:

  • Color, shade, and tone differences

  • Veining, fossil marks, and mineral movement

  • Texture and surface variation

  • Natural pits, filled areas, and irregularities

  • Size and thickness tolerances (up to ±2 mm)

These characteristics are normal, expected, and NOT defects.

By placing an order, you expressly acknowledge and accept that:

  • Product photos, website images, and samples are representational only

  • Exact color, shade, pattern, or thickness matching is not guaranteed

  • Natural variation cannot be used as a reason for returns, refunds, disputes, chargebacks, or claims


3. Back of Tile & Manufacturing Characteristics

The backside of natural stone tiles may show:

  • Rough or uneven texture

  • Saw marks or natural voids

  • Mesh backing or reinforcement

  • Hairline cracks not affecting structural integrity

Backside appearance does not affect performance, is not visible after installation, and is not considered damage or defect.


4. Orders, Processing & Cancellations

Orders are considered final once processed.

Cancellation fees apply as follows:

  • Before packing: 5% processing fee

  • Before shipping (after packing): 10% fee or store credit to avoid fee

  • After fulfillment or shipping: 25% restocking fee

  • Orders placed on hold at the customer’s request and later canceled: 25% fee applies

Once material is shipped, orders cannot be canceled without applicable fees.


5. Shipping, Delivery & Risk of Loss

American Stone Center ships via FedEx, UPS, USPS, freight carriers, and other reliable logistics providers.

  • All shipments are insured during transit

  • Customers must inspect deliveries at the time of receipt

  • Visible damage must be noted on the delivery receipt

  • Concealed damage must be reported within 24–48 hours with photos

Failure to follow these steps voids eligibility for claims.

Once a carrier confirms delivery:

  • Lost, stolen, or unattended shipments are not the responsibility of American Stone Center

  • Customers must file claims directly with the carrier

Redelivery fees, storage charges, incorrect address fees, or refused deliveries are the customer’s responsibility.


6. Breakage Allowance (Industry Standard)

Up to 5% breakage during transit is considered normal in the natural stone industry and may be used for cuts.

Breakage under this allowance does not qualify for replacement, refund, or claim.


7. Returns & Refunds

All returns must comply strictly with the American Stone Center Return Policy.

Key points:

  • Customer pays all shipping costs unless the return is due to our confirmed error

  • Returns due to color, shade, variation, thickness, or appearance dissatisfaction are not permitted

  • All eligible returns are subject to a 25% restocking fee

  • Original shipping costs are non-refundable


8. Samples

Samples are small reference pieces only and do not guarantee:

  • Exact color match

  • Exact shade

  • Exact batch or shipment appearance

By purchasing samples or full orders, you acknowledge this limitation.


9. Inspection & Installation

All materials must be inspected before installation.

Once installed:

  • Material is considered fully accepted

  • No claims, returns, refunds, or disputes will be honored

  • Installation signifies approval of material condition

American Stone Center is not responsible for:

  • Installation costs

  • Labor charges

  • Removal costs

  • Delays or project-related expenses


10. Chargebacks & Payment Disputes

By purchasing from American Stone Center, you agree NOT to file chargebacks or payment disputes related to:

  • Natural stone variation

  • Color or shade differences

  • Thickness tolerance

  • Backside appearance

  • Breakage under 5%

  • Shipping delays or carrier-related issues

  • Restocking fees or return shipping costs

All disputes must be addressed directly with American Stone Center.

Unauthorized chargebacks will be vigorously contested with supporting documentation, including accepted policies, delivery records, photos, and carrier confirmations.


11. Limitation of Liability

To the maximum extent permitted by law, American Stone Center shall not be liable for:

  • Indirect or consequential damages

  • Incidental losses

  • Installation-related costs

  • Project delays or downtime

Liability is strictly limited to the original purchase price of the product.


12. Governing Law & Jurisdiction

These Terms of Service are governed by the laws of the State of California, USA.

Any legal action or dispute shall be resolved exclusively in Orange County, California.
